After years of practicing family law I have come to believe that resolution of family law issues out of court is the best option for many people, particularly in cases involving children. The Collaborative process offers a unique way of negotiating family law issues out of court in a non-adversarial, civil, and creative manner.

When acting for a client in a Collaborative Family Law case I work with them to seek the best possible resolution of their legal issues while always keeping in mind my client’s individual needs and interests.

As a family law lawyer for more than 25 years, it is my privilege to assist my clients to achieve balanced and fair resolutions to their family law issues in a timely and efficient manner. I believe that the Collaborative Process is the most economical and efficient way for clients to achieve complete and long lasting resolutions of their family law matters. I have a keen interest in applying my collaborative skills to assist my clients to reach fair and reasonable resolutions for their families through a respectful, creative and client focused process. I was called to the Bar in 1988 and practice exclusively in the area of family law. Since 2003 my practice has included collaborative family law negotiation. I have been a panel lawyer with the Office of the Children's Lawyer since 1997. I was appointed to the Family Court Community Liaison Committee in 1999. In 2006 I was appointed as an Alternate Dispute Resolution lawyer for the Durham ADR Project (Child Protection). In 2011 I was appointed as a Dispute Resolution Officer in the Superior Court of Justice. I am a Director of Collaborative Practice Durham Region.

I am strong proponent of the Collaborative Process because it allows spouses to move forward with dignity and respect for one another. Although separation is a difficult process, many separating spouses have a longstanding relationship, and will continue to encounter one another after the legal process has concluded. This is particularly so where there are children present. In these cases, it is more important than ever that the separation process is not laden with conflict and animosity, and the Collaborative Process makes this possible. My goal is to empower my clients through the separation process, by providing them with the information, skills and support needed to make important decisions during the separation process, and to successfully navigate through the next chapter of their lives.

I believe that separation and divorce are painful enough without the emotional and financial cost of a long, drawn-out family court case. Litigation forces separating spouses to become adversaries, usually with their children caught in the middle. By contrast, collaborative practice allows separating couples to settle the issues that need to be settled while moving forward in their lives with mutual respect, dignity and civility and - most important - children who are not forced to see their parents as enemies. Collaboratively-trained lawyers, financial professionals and family professionals are committed to this vision, and I am thrilled to be able to offer this process as an option to my family law clients.

I have practised exclusively in the area of Family Law for over 20 years. I completed my Collaborative Law training while practising as an associate in a Family Law firm in London, Ontario. In August 2003 I relocated to Oshawa, Ontario where I continue to practice Collaborative Family Law as a sole practitioner. I find the practice of Collaborative Family Law to be rewarding in that it allows for flexibility and creativity when crafting solutions for separating families. I have been a member of the Office of the Children’s Lawyer legal panel, representing children in custody and access disputes, since April 2004 and in December 2010 I was appointed as a Dispute Resolution Officer in the Ontario Superior Court of Justice, Family Court in Oshawa.

Respect . . . dignity . . . creativity . . . empowerment . . . These are the kinds of things that are effectively stripped from participants in the Family Court system. By contrast, one of the goals of collaborative practice is to preserve these very fundamental values. In my practice, I have found that almost always the best resolutions are created when the participants themselves are given the support and guidance to structure their own futures. The commitment of all members of a collaborative team is to create a negotiating environment where this can occur. I have worked in family law since 1989, and as part of the collaborative practice movement since 2003.

Paula has been practicing family law in Durham Region for over 10 years. She believes that Collaborative Practice allows families to maintain their dignity through a difficult period in their lives. Parents can focus on the best interests of the children by maintaining open lines of communication and sharing information in a non-adversarial environment. Collaborative Practice permits separating couples to generate their own settlement options and to come to a mutually acceptable resolution that works for them versus letting a Judge decide the outcome.

I have practiced primarily in the field of Family Law for the last 32 years. As a Collaborative Lawyer, I help couples separate and divorce intelligently and creatively, considerate of one another and their children’s needs. I believe that couples should be given the opportunity to choose a process for resolving their differences that honour their participation and trust their ability to make decisions for their families. Collaborative practice invites couples, even those in very high stress relationships to explore all of the various options available to resolve their differences so that their family can move in a positive fashion.

Marie has 20 years of experience in the family law sector, starting as a law clerk for a family law lawyer on Bay Street, and after her Call to the Bar, as a practitioner of family law, wills and estates in Ajax. She has a unique style in dealing with clients that helps to put them at ease while simultaneously addressing their legal needs and keeping them grounded in reasonable expectations. While Marie is a proficient litigator, over the years of waiting in the hallways of the Courthouse for her clients’ cases to be called, she has observed more and more dissatisfied parents leaving the Courthouse wondering out loud how things could have turned out so badly for everyone when they allowed a stranger to their family (the Judge) make the decisions about their futures as separated parents. That is the result of litigation - someone else deciding your fate! The collaborative approach allows parents to join as a team working for their separated family, rather than fighting against one another to "win" at all costs, including the children’s and their own emotional well-being. The collaborative process is the way for everyone to win, especially the children who will have two separated parents who will likely have learned to communicate well with and respectfully toward one another as they parent post-separation.

I believe that, given the opportunity and with the right information, people will make the right decision for themselves and their family. I believe that for many people, Collaborative Process creates that right opportunity. I ensure that my clients know and understand all of their options and together we create solutions that best suit their situation and family's needs. I support my clients in balancing the need to manage the emotional struggles of a separation and divorce, while also using logical and practical approaches to guide them towards achieving timely, cost-effective and successful results. In my Collaborative Law practice, I work with clients to move through the initial chaos and uncertainty of a separation toward closure and a final resolution of the parenting, child and spousal support and property issues. My commitment to respectful and interested based negotiations extends to my involvement with various Collaborative Practice groups throughout the GTA. I am a Board Member of both York Collaborative Practice and Collaborative Practice Durham Region and a member of Collaborative Practice Toronto. I have been practicing family law exclusively since 2003 and have been trained in Collaborative Law since 2010.

We choose to practice family law to help those faced with the challenges of separation – emotional, financial, and legal. I strive to lend assistance in each of these areas, while maintaining the goals of cost-effectiveness and timely resolution. Working with a team of professionals, each skilled in one of these areas, is an interest-based, goal-oriented, and very personal way to negotiate and craft a real-world resolution to the issues one must address when separating. They are, after all, your issues and to find a solution to them is an empowering way to begin your new life, apart from, but to some degree still aligned, with your former partner, especially if you have children together. Solutions that are crafted by the separating couple, with the assistance of trained legal, financial and therapeutic professionals, result in a greater willingness to work together to deal not only with the separation itself, but with the myriad of issues, big and small, that will inevitably arise within the family as you continue to parent.

My commitment to Collaborative Practice marked a turning point in my legal career. Like many dedicated family lawyers, I was slowly coming to a point where I could no longer tolerate the damage I was leaving in my wake as an adversarial family practitioner. Collaborative Practice has enabled me to rededicate myself to helping people solve legal problems while preserving relationships. Working in a team setting with our collaborative colleagues skilled in helping couples work out the financial, emotional and parenting issues that occur on the breakdown of family relationships, I once again feel I am part of a helping profession.

Practicing family law for nearly 28 years and being a police officer for five years before that has given me broad experience and insight into relationships. It is through this experience that I came to realize there had to be a better way emotionally and economically for parties to resolve their differences and move forward in their lives with dignity and a positive outlook. Practicing collaborative law is such a way. The very expensive and adversarial court process is replaced with interest-based team negotiations focusing on mutually agreeable resolutions. I am now practicing on a part-time basis from my home and can offer flexible hours.

Family Professionals

I have been a social worker for over 20 years. During this time I have helped individuals, couples and families deal with personal challenges and life transitions including separation/divorce, mental health, grief and loss, parenting concerns, and substance abuse. I have worked in hospital, government, addictions services, Employee Assistance, and private practice settings. I am a member in good standing of the Ontario Association of Social Workers, the Ontario College of Social Workers and Social Service Workers, and a new member of Collaborative Practice Durham. I am excited to offer my skills as a Family Professional where I can fill the roles of separation coach, child consultant and neutral facilitator as required by the Collaborative Team. The principles of Collaborative Practice engage me in a way that seems a perfect match for my strength-based and client-centred philosophy. Divorce is one of the most stressful events a couple/family can experience. I believe that a compassionate approach and the right support can help couples and families maintain the best possible family relationships during and after the separation and divorce process.

John is a Partner at Fairmore - a firm offering analytic services to couples and individuals working through separation & divorce. The firm provides lifestyle analysis, transitional budget preparation, pre and post settlement planning, comparative financial status and alternative scenario planning to assess obligations today and into the future. We create ‘what if’ scenarios that help the parties reach equitable agreements quickly and with conviction. Our firm does not offer wealth, tax or insurance advice, products or services beyond or outside the separation and divorce process. Our firm’s Principals are legally-trained non-practicing members of the Law Society of Upper Canada holding the Certified Divorce Financial Analyst (CDFA) designation as members of the Institute of Divorce Financial Analysts (IDFA). We’re not a typical advisor firm. Our legal background offers deep insight about how judges, lawyers and individuals need and use financial analysis within the legal process. Fairmore offers private, neutral, client-centered services that focus on financial transparency, clarifying priorities, surfacing and reconciling differences - enabling clients to take ownership of their own process at a pace they are comfortable with. Our work enables both spouses to feel confident in the answers to three key questions: Is this agreement fair to me? - Am I giving away too much? - Am I going to be ok – now and in the long term?

Respect . . . dignity . . . creativity . . . empowerment . .

Valerie has been practicing family law for twenty years. The focus of her practice has always been on assisting and supporting clients in reaching a resolution of the issues arising out of their separation without resorting to the courts whenever possible. A member of the Collaborative Practice Group in Durham Region since its inception, it has been Valerie’s experience that Collaborative Practice is the most respectful, effective and least damaging way for separating couples to reach an agreement that meets the needs of themselves and their families, particularly for families where children are involved.

Using the Collaborative method to resolve your family law issues allows you to be creative. It helps you preserve your relationships, resources and privacy. You get the benefit of legal advice throughout and not have to endure the adversarial nature, and pitfalls, of litigation. You can access financial and divorce coach professionals who are trained to work collaboratively with you and your family. It is not suitable for everyone but by considering the collaborative alternative you are taking a positive step. I will help you craft a lasting solution that meets the needs of your family and particular circumstances. I have practiced family law for 20 years, helping clients resolve their issues, in the court system, and out. I am a trained Mediator as well as Collaborative lawyer.
